The rules they past through will make it\nhard is not impossible for full spectrum CBD oil to be made as it\u2019s\ndiscriminatory to high CBD strains of hemp. You\u2019ll find the only places making\nCBD oil will be the states where marijuana is legal, because that\u2019s what high\nCBD hemp plants will now be qualified as. <\/p>\n\n\n\n<p>The rules that will be screwing over Flower strain growers\nare highlighted below: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Delta 9 THC was\n     reclassified as being Total THC (THC-A plus DELTA-9)<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Hemp must be tested by DEA\n     registered labs 15 days before harvest from the top 2\u201d of the plant with\n     bud<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>The USDA encourages using\n     GC method for hemp testing (Which over bloats the THC numbers and is\n     generally inaccurate in results.)&nbsp; <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>ALL states must comply\n     with the points highlighted in their plan and adjust all their plans to\n     include their points. Any laws a state has now get thrown out the window\n     for the USDA\u2019s. <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>USDA refused to put out an\n     official seed program as they speculate a seed will turn into a legal\n     plant in one state will grow hot in another. <\/li><\/ul>\n\n\n\n<p>In simple, to grow Hemp for CBD growers\u2019 biggest worry is no\nlonger just DELTA-9 but now it\u2019s THC-A, the non-psychoactive pre curser to\nDELTA-9. THC-A only turns into DELTA-9 if it is smoked, and does not convert in\nthe CBD oil making process. All of hemp is now being discriminated as though it\nis all for smoke able bud. The legal limit is still 0.3% which is a number too\nsmall for total THC as THC-A will be on average 0.3% on a flower strain HEMP\nplant, not marijuana. <\/p>\n\n\n\n<p>To add to the mayhem the testing practices the USDA is\nenforcing will overbloat THC numbers so that no flower\nstrain will test legal. In their report: 70% of all people growing hemp went\ninto CBD oil. Meaning all 70% will lose their whole crop and no one is going to\nmake money under that. The testing methods only\nbenefit fiber yet the report itself confirms hemp for CBD oil purposes. These\nrules will lead to the destruction of the American farmer as many do not have\nthe experience to grow hemp in the very specific way the USDA presents with the\ninterim rules. Many will lose 10\u2019s-100\u2019s of thousands of dollars. With High CBD\nstrain\u2019s variability in THC numbers and can go hot on a moments notice add on\ninaccurate and discriminatory anti-CBD practices that are being enforced and it\nwill kill the market. <\/p>\n\n\n\n<p>Total THC:<\/p>\n\n\n\n<p>The reason this was implemented was because its\u2019 seen THC-A\nwhen burnt will turn into DELTA-9. This only applies to the smoke-able bud\nmarket. That\u2019s it. Even then Total THC is discriminatory as THC-A is a variable\nscience with no accurate ways to make that number go down. They even confirm in\nthe report that a legal plant will go hot depending on where it\u2019s grown.&nbsp; This will make it impossible to grow hemp for\nCBD oil as when CBD goes up THC-A will be on average 0.3%-04%, already over the\nlegal limit. Under Total THC, THC-A will be the killing factor for many growers\nmaking a loss in profit for the whole industry. THC-A doesn\u2019t get converted to\nDELTA-9 THC in the CBD oil market because the process never heats up the acid\nenough to decarboxylate it. <\/p>\n\n\n\n<p>The definition should be brought back to the original\nEuropean definition where they test for the DELTA-9 pre decarboxylate or Total\nTHC should be brought up to 0.6% at least if a growing and prosperous CBD\nmarket is possible. Total THC\u2019s legal number of 0.3% is based of the European\ndefinition where they test differently meaning that if the number is going to\nbe inflated by THC-A, then the legal limit must also be brought up with it. <\/p>\n\n\n\n<p>With these rules unchanged it will be more likely to win the\nlottery as a career then grow hemp for profit. <\/p>\n\n\n\n<p>DEA Registered labs:<\/p>\n\n\n\n<p>There aren\u2019t enough labs to make this possible. The wait\nperiod alone will kill profit on crops as they sit and wait for either the slow\nprocess of a lab getting approved or a long wait list of an over worked lab.\nMost states have under 20 state approved labs and even less DEA approved labs\nand states like Tennessee where there are thousands of growers there would be a\nhorribly long wait list that could get into the 6 month to 1 year range. Add on\ntop of this if a crop comes in hot that will lead to a full loss of profit when\nit will be automatically reported due to the inflated numbers of total THC. Add\nthat the grower takes on the cost of testing, the price will inflate because of\nhigh demand leading to inflated testing process and a severe stopgate in price\na grower has to incur just to sell their crop. <\/p>\n\n\n\n<p>There should be a plan of action to make sure there are\nenough labs in relation to the number of growers or make simply make this\nunnecessary. The more of a closed group you make the labs the harder it will be\nfor the majority to get their items tested. <\/p>\n\n\n\n<p>Testing methods:<\/p>\n\n\n\n<p>Everything that was encouraged will further bloat numbers\nwhere a normally perfectly legal hemp plant will test hot. It\u2019s a system that\nsets up the grower to fail and punishes them for growing. Taking from the top\n2\u201d of the plant will lead to the misleading results as THC-A grows upward.\nBeing THC-A is the deciding factor now it, it makes it so no flower variety\nwill come in legal. It will be legal hemp discriminated as marijuana because it\nwas setup to fail. GC method already is documented as inaccurate in measuring\nTHC and bloats the numbers overall because of the post decarboxylating process.\nWith labs being needing to use the method to be certified will lead to a lot of\nfailed crops. Add this with Total THC and the CBD industry is stifled and\ndestroyed as something that would traditionally test 0.1% DELTA-9 could be\ninflated to the point of testing 0.3% just from practices alone before Total\nTHC is added on. <\/p>\n\n\n\n<p>The testing 15 days before harvest will lead to low quality\nplants. This will lead many growers to harvesting early and will not show\naccurate numbers. In 2019 alone many growers kept their plants in the ground\nuntil October because of a very unbeneficial hot wet summer. Because of this\ndelay there no way to make a specific date to harvest. The practice of\nharvesting early will lead to a wetter plant more likely to develop mold and\nmycotoxic fungi that could hurt people in the long run.
